Just days prior to Donald Trump’s recent indictment, former New York Police Commissioner Bernard Kerik handed over a collection of documents to Special Counsel Jack Smith. These documents reveal that the Trump legal team was engaged in a comprehensive investigation resembling that of law enforcement, which had yet to resolve the majority of the allegations regarding election fraud in 2020. This investigation was ongoing before the Capitol riot on January 6th.
The Kerik memos have the potential to significantly impact the prosecution’s case against Trump, particularly regarding Smith’s broad assertions that Trump was aware of the falsehood of his claims on election irregularities and knowingly committed fraud in an attempt to delay the certification of election results by Congress on January 6th, 2021. One of Kerik’s lawyers, who spent months examining the memos, provided this information.
Attorney Timothy Parlatore, who has represented both Kerik and Trump at different times, believes that the memos serve as exculpatory evidence, shedding light on the state of mind of Trump, the legal team, and their collaborators.
“The Giuliani team believed that they had uncovered evidence establishing probable cause to suspect fraud in the election. This warranted further investigation, which required time and resources that they did not possess in order to definitively prove or disprove the allegations,” Parlatore stated in an interview with Just the News.
“Even if these allegations were later debunked, or even if they were proven but insufficient to alter the outcome, it does not change the fact that on the night of January 5th, Kerik, Giuliani, and President Trump all reasonably believed that there was fraud that could have influenced the outcome,” Parlatore added.
