Jussie Smollett’s legal team filed a request for the dismissal of the hate hoax charges against him in an Illinois court on Tuesday.
In a 76-page written appeal reported by USA Today, Smollett asserts that his trial violated his Fifth Amendment right not to be tried twice for the same offense.
The appeal primarily centers on his fulfillment of community service and payment of a $10,000 bond, which were part of a 2019 agreement with the Cook County State Attorney’s Office to have the charges dropped. This agreement became a central point of contention during Tuesday’s hearing.
