In a 4-1 ruling, the Indiana Supreme Court has declared the state’s abortion ban constitutional, according to the court’s decision issued on Friday.
The ban, known as Senate Bill 1, was enacted into law in 2022. It prohibited most abortions with only limited exceptions, such as when the pregnancy posed a serious health risk to the woman or to save her life, or in cases where the child was diagnosed with a “lethal fetal anomaly,” or in instances of rape or incest, as outlined in the bill.
Shortly after its implementation, the law was challenged in court by Planned Parenthood Great Northwest, leading to a temporary injunction. However, the state Supreme Court has now overturned that decision, ruling that the law does not violate the Indiana Constitution.
