
A federal court in the District of Columbia has begun to process a motion asking for a judge to protect five transgender service members from the Trump administration order that blocks the continued service of transgender members.
The motion specifically asks for a temporary restraining order against the government and said the plaintiffs, “are currently being subjected to specific adverse treatment.”
The motion also claimed, “Absent emergency injunctive relief, these Plaintiffs will be irreparably harmed.”
All five according to the motion, have had their military careers essentially placed on hold.
The motion points to the Trump administration military transgender ban as a means of “branding” the plaintiffs as incapable solely because of their transgender status.
“Such a ‘status-based enactment divorced from any factual context’ violates the equal protection guarantee of the Constitution, which prohibits the government from labelling a group as ‘unequal to everyone else’ based simply upon their status.”
