Lawsuit Filed Against Wisconsin State Bar Over ‘Discriminatory’ Diversity Internship

In Wisconsin, a lawsuit has been filed against the State Bar over accusations of “discriminatory” Diversity, Equity, and Inclusion (DEI) practices. The Wisconsin Institute for Law and Liberty (WILL) filed the suit on behalf of attorney Daniel Suhr, citing that the bar’s “Diversity Clerkship Program,” which allegedly offers exclusive internships to racial and sexual minorities violates the 14th Amendment and discriminates against non-minority Wisconsin attorneys.

The suit was filed in the United States District Court for the Eastern District of Wisconsin, and WILL Associate Counsel Skylar Croy emphasized that the government’s discrimination based on race violates the Constitution, “sowing more division in our country…” Croy stated that they would hold the State Bar accountable to the rights of its due-paying members.

The Diversity Clerkship Program is described as a 10-week paid internship for first-year law students from Marquette University Law School or the University of Wisconsin Law School. According to the State Bar, the program targets “backgrounds that have been historically excluded from the legal field,” and applicants must be in good standing.

Daniel Suhr asserts, however, that internships should be open to all students, regardless of their backgrounds. Suhr acknowledged that internships are competitive, but he believes that when one group is given preferential treatment, the program loses competitiveness, hurting all Americans. He added that the State Bar should “do better and expand these opportunities to all Wisconsin law students.”

The lawsuit suggests that the “Diversity Clerkship Program” should not exist. At a minimum, the lawyers argue that dues from bar members should not fund the internship. This program is accused of violating the equal protection rights of law students and WILL aims to hold the State Bar accountable for its practices.

The Wisconsin Institute for Law and Liberty (WILL) based the argument on protecting equal rights and acting against usurpation. WILL also emphasized the importance of ending systemic discrimination throughout America, citing the due process and equal protection clauses of the United States Constitution.
